By accessing or using the Crest Rock Finance platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy.

If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-platform notification at least 30 days before taking effect. Continued use of the Platform after such notice constitutes acceptance of the revised Terms.

To use the Platform, you must:

• Be at least 18 years of age.
• Be a resident of the United Kingdom or an eligible jurisdiction.
• Not be a person subject to economic sanctions or located in a sanctioned jurisdiction.
• Successfully complete our identity verification (KYC) process before accessing financial services.

Corporate entities may register subject to enhanced due diligence. We reserve the right to refuse service at our sole discretion where regulatory or compliance concerns arise.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. Each individual may hold only one personal account on the Platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access or security breach via our contact page.

We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, provided false information, or if required by our regulatory obligations. Account suspension does not affect our right to pursue legal remedies.

Crest Rock Finance offers gold-mining-linked investment products including the Gold Mining Fund, Gold Mining Tranches, and Gold Performance Notes. Each product has distinct terms, risk profiles, minimum investment requirements, and liquidity schedules as described in the relevant product documentation.

Joint investments are subject to the joint investment agreement between co-investors. Each co-investor's ownership percentage, withdrawal rights, and beneficiary designations are defined at the time of investment and recorded on the Platform.

Beneficiary designations are non-binding instructions that will be honoured subject to applicable law and our inheritance claim verification process. Designated beneficiaries do not acquire rights to the investment until the inheritance transfer is completed.

Loan products are subject to credit assessment and approval. An application does not guarantee approval. Approved loans are governed by a separate loan agreement that forms part of these Terms.

You agree to make all scheduled repayments in full and on time. Failure to do so may result in late fees, adverse credit reporting, and enforcement action as detailed in your loan agreement. Development and bridging loans require asset security, which may be enforced in the event of default.

Early repayment terms vary by product. Personal loans carry no early repayment penalty. Development and bridging loan early repayment conditions are stated in your individual loan agreement.

Fees applicable to each product are disclosed in the relevant product documentation and on our Fees page. You agree to pay all applicable fees associated with your use of the Platform and its services.

We may revise our fee schedule from time to time. Any fee changes will be communicated at least 30 days in advance. Continued use of the affected services after the effective date constitutes acceptance of the revised fees.

All amounts displayed on the Platform are in GBP unless otherwise stated. You are responsible for any taxes arising from your use of the Platform, including but not limited to capital gains tax and income tax on investment returns.

All content, software, designs, trademarks, and other intellectual property on the Platform are owned by or licensed to Crest Rock Finance Limited. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our express written consent.

You retain ownership of any information and documents you submit to the Platform. By submitting content, you grant us a non-exclusive, worldwide licence to use, store, and process that content as necessary to provide our services and fulfil our regulatory obligations.

To the maximum extent permitted by law, Crest Rock Finance Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or investment returns.

Our total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating formal proceedings, you agree to attempt to resolve any dispute through our internal complaints procedure. Details are available on our Contact page. If the matter remains unresolved, you may refer your complaint to the Financial Ombudsman Service where eligible.
